Tonse Alliance partner Peter Sinkamba has rejected the Constitutional Court’s judgment barring the alliance leader, Edgar Lungu from future elections.
Sinkamba has declared the judgment of the Constitutional Court today, “illegal and unconstitutional.”
He stated that the court had no authority to overturn its earlier decision, which deemed former President Edgar Lungu eligible to contest the 2021 elections.
He affirmed that Lungu remains the alliance’s presidential candidate for the 2026 elections.
“This court has clothed itself with powers it does not have. By doing so, it has breached Article 5 of the Constitution, which clearly states that powers not allocated to institutions belong to the people and must be exercised through a referendum. This judgment is unconstitutional, illegal, and null and void,” he said.
Sinkamba said Tonse Alliance would not accept or abide by the court’s decision, citing its alleged illegality.
He condemned the court’s reliance on repealed constitutional provisions, such as Article 35, and its interpretation of sections 2 and 7 of the 2016 Act, arguing that these cannot supersede the Constitution, which is the supreme law of the land.
“It is absurd that the court relied on repealed provisions to make its judgment. Once repealed, such provisions are of no effect and cannot be used as a basis for future decisions. This action sets a dangerous precedent for our jurisprudence,” Sinkamba added.
While ruling out a petition against the judgment, Sinkamba promised that the alliance would revisit the matter if it wins the 2026 elections.
“In 2026, after winning the elections, we will correct these unconstitutional acts. We cannot allow illegal judgments like this to become the foundation of our legal system. We will reconstitute the Constitutional Court to ensure it is staffed with competent individuals who uphold the Constitution rather than breach it with impunity,” he declared.
Sinkamba called on members of the people’s pact to remain resolute in their support for Lungu, vowing to pursue justice through lawful means.
