Suspended Lawyers Drag LAZ President to Court

Must read

Law Association of Zambia (LAZ) president, Lungisani Zulu, and the association are facing a court challenge over the suspension of two lawyers, Arnold Kaluba and Mulenga Sholomo.

The two have sought leave from the Lusaka High Court to challenge their suspension during the Christmas vacation.

Before suspension, Kaluba served as LAZ honorary secretary and chairperson of the Junior Lawyers Committee and Mulenga Sholomo, as chairperson of the House and Welfare Committee.

The suspension stems from a letter the two lawyers wrote to the Legal Practitioners Committee (LPC) on behalf of 399 newly qualified lawyers, who were scheduled to be called to the bar in December 2024.

The lawyers had raised concerns about paying the full 2024 subscription fees, given that they would only practice for a few weeks in the year.

Kaluba and Sholomo are seeking judicial review of their suspensions, arguing that the decision was illegal, procedurally flawed, and irrational.

They claim that their suspension would adversely affect their standing as legal practitioners and their ability to earn a livelihood.

The two lawyers have asked the High Court to quash the decision of the LAZ council to suspend them.

They also seek a declaration that the decision to suspend them is illegal, procedurally improper, and irrational

Kaluba and Sholomo want the court to compel LAZ to restore them to their elected positions as members of the council.
