PF Faction Secretary General Seeks Court Order to Declare Matero Parliamentary Seat Vacant

Patriotic Front (PF) faction Secretary General Morgan Ng’ona has filed a petition in the Constitutional Court seeking an order for the National Assembly to declare the Matero parliamentary seat, currently held by Miles Sampa, vacant.

In the matter before the court, Ng’ona, suing in his capacity as Secretary General of the PF, has named the Attorney General and the National Assembly as respondents.

He contends that on July 3, 2024, the PF Central Committee, during a meeting at Mass View Lodge in Lusaka, resolved to expel Sampa from the party.

Following the expulsion, the petitioner notified the Speaker of the National Assembly in writing on July 3, 2024, and again on July 4, 2024, informing her of the development.

Ng’ona argued that despite the notifications, no action was taken to declare the Matero parliamentary seat vacant.

A subsequent notification was sent on November 11, 2024, reiterating the expulsion, but the Speaker still did not act on the matter.

The petitioner argues that this inaction contravenes Article 72(1)(e) of the Constitution of Zambia, as amended by Act No. 2 of 2016, which provides for the vacancy of a parliamentary seat when a member ceases to belong to the political party under which they were elected.

Ng’ona seeks a declaration that the failure of the National Assembly to declare the Matero seat vacant contravenes Article 72(1) of the Constitution.

He also wants an order compelling the National Assembly to immediately declare the seat vacant and notify the Electoral Commission of Zambia.
