Constitutional Court dismisses petition against Miles Sampa as PF President

A petition brought by nine faction members of the Patriotic Front (PF) challenging the leadership of party president Miles Sampa and secretary general Morgan Ng’ona has been dismissed by the Constitutional Court.

The court ruled that the petition was not appropriately brought before the Constitutional Court and did not raise any constitutional issues for consideration under article 128 of the constitution.

Additionally, the court stated that the petitioners failed to show how article 60 sub-article two of the constitution was violated in the election of PF president Sampa.

Furthermore, the court determined that the petitioners did not provide evidence of Mr. Sampa breaching the constitution when appointing Ng’ona as PF secretary general.

The court concluded that the main focus of the petition was on the private rights of the petitioners, which are within the jurisdiction of the High Court.

The judgment was delivered by a panel of six Constitutional Court judges.
