ConCourt President and Predecessor Subpoenaed to Testify in Suspended Judges’ Hearing

Constitutional Court President Margaret Munalula and her predecessor, Hilda Chibomba, are set to testify tomorrow in a hearing concerning three suspended Constitutional Court judges. The pair have been subpoenaed by the Judicial Complaints Commission (JCC) as part of the ongoing proceedings.

This development follows the conclusion of the defense presented by the suspended judges—Annie Sitali, Mungeni Mulenga, and Palan Mulonda—during a closed session held yesterday at the Lusaka High Court’s Commercial Division. The judges were suspended on September 23, 2024, based on recommendations from the JCC.

In a related matter, the judges’ attempt to challenge their suspension through a Judicial Review has been unsuccessful. The Lusaka High Court, on October 12, ruled that it lacks jurisdiction to hear their application, leading to the dismissal of their case by a panel of judges, including Charles Zulu, Chilombo Maka, and Twaambo Musonda.
